Hiding out in St. Maarten?

Could Kenneth McKenzie of Century 21 be the same Kenneth McKenzie who apparently violated a restraining order in 2000, precluding the transfer or conveyance of assets which disappeared, along with defendants, after judgment?

All of these Ken McKenzie comments are the work of one, yes one woman who does not like him and told me a few months ago that she would take him down. I didn't know what she meant at the time. She has created this grand illusion that so many people are looking for Ken because of stuff he has done. Not the case. He is here, and is not hiding. He goes to work every day, travels to the USA from time to time, and is a business man who outsmarted, NOT SCAMMED the woman who is responsible for this slander. Why does she not say who she is? Why don't any of the supposed people say who they are? The answer: the whole Ken bashing thing is a scam.

My wife and I were introduced to this interesting site from JMB communications. A site for St. Maarten. We have been coming to the Island for more than 5 years and thought seriously about buying. Are you saying that this Realtor McKenzie Outsmarted, and not Scammed this woman? No thank you, since when are Realtors supposed to outsmart their clients? If the C21 heads cannot help victims who have been wronged than that seems reason enough to stay away.
This was discouraging to us and we decided to follow along and see if this guy get his due. We won't be buying on this Island unless someone can refer a person of character. Are there any?

I think if any person searched the NJ court web site, they could probably find the legal ruling themselves. Oh, Delusional, how do you account for the Horon ruling that is posted?

You state that all the comments appear to have all been written by one woman.Oh contrare! I myself wrote one, and only one, of the numerous postings earlier. Truth is not slander, Delusional. Ken McKenzie stole a TV, airco units, microwave and other misc kitchen stuff out of an apartment he was renting in Apr 2005. Ask Det Elisabeth of the Phillipsburg police who took the police report. Ken, (Mr. Property Manager, Mr. Smart Businessman, Mr. Century 21), refused to pay 4 months rent, and we had to get a court order to get his butt out while he played little games, and a later court order to get him to pay up. He obviously thought he wouldn't be pursued. HA!
So Delusional, was Ken such a smart man as you say when he finally had to finally cough up the back rent and then some more plus legal costs of his own?

Remember the old adage, "when you sleep with dogs, you get fleas?" Unfortunately in your case, it appears you didn't get fleas, just a case of blindness. Wake up, Delusional. Tigers don't change stripes.

Why does C21 keep Ken on? Maybe Ken has something on the owner. Ken just fired a nice lady who has been with the company since it started. Ken was proud to have snitched her from CB. She was wise to Ken and his ethics so she had to go, so that Ken and the owner of C21 could continue to be protected.

In my humble opinion these Pirates; Ken and Daunesh flying under the flag of Century21, have no business in legitimate business. Unfortunately though, there are fresh victims to prey on sailing in our waters every day, believing C21 is a reputable flagship. Wrong!!!
These C21 Pirates in my opinion, should all be drawn and quartered.
There are many SXM business people that have nothing more to do with these people or C21for that matter. Good business people who believe; if you have integrity nothing else matters. If you don’t have integrity nothing else matters.
Just look at their crew … in my all my days, a shadier crew of misfits I have never seen. They bait their hooks with pictures in the paper, big smiles and even bigger signs everywhere, trying to pull the old 'bait-n-switch' to baffle their victims with lies and BS stories.
I'm sorry to say; there's not an ounce of professional integrity in the bunch.
Mark is just an apprentice baiter right now but he’s learning from the master and will graduate soon. Then there’s Pamela, in my opinion a wicked witch. And Ritika the worst witch and then there’s Cathy just an ordinary witch … I think they're all Pirates!

By Flipper in a comment two below this one. The only information that appears to be solid is the document linked to. This document implies that Ken Mckenzie is on the run and a fraudster. There are also several local stories and rumors which support this.
If you have any evidence of further wrong doing on the island, send us the evidence. We would still like to hear from US citizens who are able to track down the lastest information about this document and case.

The set up of Century 21 caribbean is professionally run and administered. Slating the operation is not a good thing to do. Horst Finkbeiner is a extremely likeable individual who has an impeccable reputation throughout the Caribbean and Bermuda. His boss also carries that same reputation. McKenzie's picture has been removed once again from the Century 21 website. He has done that before when the pressure was on. However there are sightings of his vehicle, so he may still be on Island.

Another note - Can you please clarify why you think Ken is hiding or on the run. On the run from whom? The document that we posted here is from 2001 and we have no information to tell us that anyone is still actively looking for Ken. Nor do we have any proof he has done anything wrong here on the island other than personal stories which, although I have no reason to doubt, have not been backed up with any proof or documentation.
Now, if you have a lawyer friend in the US you might ask them for a favor to look up this case and find out it's status. :) - Flipper

I won't be crude about Pamela Saith, but I will tell my first hand story about what Ken Mckenzie had her do. He had her watch my unit at Cocos Beach Club, as Ken (who also owned a unit there) watched secretly from his deck.
Ken knew I would be arriving on Island to finally close on a house he had tried to steal from me and my family in a sale. When I arrived I was cautious, as I noticed his truck and her car in the parking lot. Before I opened the shutter I thought I might need binoculars, so I grabbed them. Slowly I opened the shutters. There was Pamela, walking in the shallow waters on Simpson Bay Beach, immediately in front of my unit waving her arms in the air and nodding her head "yes" in the direction of Ken's unit. I looked through my binoculars and saw Ken hiding on the side of the deck watching Pamela. She was letting him know I had arrived.
Ken uses Pamela to further his distorted way of doing business, they feed off one another, have a need to deal this way. The same as he used Gary Howkins to be his front man in his real estate holdings.
I confronted Ken about this and told him it was reprehensible, he laughed at me and said I imagined him in the binoculars.
Lies are lies with or without the binoculars, but Ken, the binoculars cinched it for me.
Time will tell.

Could it be that Ken was trying to use an eldery rich lady as his next victum, with his flirtation? Lady finds out that Ken is trying to scam her as well?

He has hidden out in several properties he owned when he thought someone was looking for him. He would move around. However this is the most recent report for today!

We know that there is a new project being develped on Cay Hill, and C21 ended up as the exclusive agents to market. The Cay Hill people heard of McKenzie's negative reputation and mentioned it to Daunesh Allcott, as did others. Cay Hill people didn't like what they heard. Daunesh made excuses for Ken then and they continued with their plans to stay with C21.

One wonders how and why the Cay Hill people would have even considered dealing with C21 with all the questions surrounding the company and it's Sales manager. McKenzie couldn't wait to get his NV registered with the Island council. He was nervous not having residency, as he was afraid he would be kicked off the Island. Where then would he go if he couldn't go back to the States. Where will he go if he has to leave the Island?

Did he tell the truth when filling out documents for Residency? These are questions many have wondered about. Who knows who will come up with the answers. We'll have to wait and see.

Why wait and see. You could notify the licensing authorities about Ken's reputation yourself. It will be difficult to issue him any license with that history. Even the Governor could be notified and asked why this person is still allowed on the Island. Shouldn't he be deported if he is in illegal hiding?

This is Ken McKenzie. Authorities have been looking for him for several years...and they found him here. He has hired a local Attorney. Besides the Horon litigation against him I understand there are 30 OPEN Judgements against him from the United States. There were more, but some creditors exhausted efforts to find him.
Still though, Judgements are into the millions. The Judgements are for Illegal Real Estate Transfers and defying Court Orders to comply. Instead Ken runs with assests.
On St. Maarten Ken continued his tactics by getting his roomate to apply for mortgages instead of Ken, so that Ken could continue to hide his identity. He has no bank accounts in his name, no real estate in his name, probably not even a car in his name, who knows? But they found him on St. Maarten, they must have wanted to pretty bad.
His boss, Daunesh Allcott knows everything and looks the other way. Why? Daunesh just tidies up Ken's train wrecks. Why? Others have gone to Daunesh to alert him and nothing happens. Does Daunesh condone Ken's behavior?

Our nightmare with Ken will finally end hopefully with the courts stopping this man from destroying our lives. We wait and continue to have faith in the Legal System, and will fight him to keep our families inheritance in OUR family.

Ken says he will pay off whomever he needs to win. Perhaps.
When I asked Ken why did he sneak his name on a Real Estate contract that was mine, he said, "I'm greedy that's why." His words ring clear, "for 30,000 to 40,000 in legal fees I have a shot at 250,000, that why I did it." I learned a few things about a con man. Con men always have the10% down deposit, and..... they can't leave the last dollars behind...and that is when they get sloppy and slip up.

Any wonder why Ken is hiding out? I doubt it is because he likes the sunshine...Ken doesn't like the sun, he lives in the shadows.

The infamous Ken McKenzie rents apartments in Simpson Beach and Beacon Hill to Medical Students and others. Ken is listed as a VP for C21. C21 engages in real estate sales, and also in rental agents of vacation property. You would think, then, that Ken would understand a Lease, and the laws between a landlord and tenant. You would also think that Ken knows a tenant has to pay the rent. But no, Ken lives only by his rules, and does his best to get out of paying money owed.

In 2005, Ken refused to pay rent for 4 months for the apartment he rented from us. We had to prove to GEBE that we were the property owners because Ken told GEBE he owned our property. After the court ordered Ken to move out of our apartment, he STOLED our TV, miscellaneous kitchen goods, and 2 airco units, all of which were reported to the police.
After many months, and a second court date, the court ordered Ken to pay the backrent. Almost a year later, Ken finally paid up ONLY when threatened to have his antics exposed to SXM officials.

Danuesh (C21 SXM) and the Caribbean Regional Manager of C21 were made aware of Ken's refusal to pay rent, refusal to move, and his stealing of our property. However, C21 continues to this day to allow Ken to represent C21 to potential investors.

Here's hoping that justice is finally catching up to Ken.

Not the only sketchy man in Real Estate

There is another well known man who was involved in a major drug bust in the 80's who has an influential family there, or did. He became a prosecution witness and ended up changing his name. Presumably as part of witness protection? I was under the understanding that to be a resident and conduct business in St. Maarten you had to have a clean record, silly me!

The whole real estate sector is unregulated and the agents are more than willing to help purchasers hide their assets in off shore companies and holdings. The N.A. just passed a law to bring in cooperation with several countries to share tax information to track people that hide assets from tax or law enforcement and it will be interesting what effect that will have, or if it will be enforced in St. Maarten.

I know a thing or two about the background of Ken 21. This is about him.

Note what the court said:
On August 19, 1998, judgment on a promissory note was entered against Kenneth in favor of plaintiff in the amount of $4,376,734.87. On July 28, 1999, judgment on a related fraudulent conveyances claim was entered against both defendants in favor of plaintiff in the amount of $1,543,524.72. Although a restraining order was also entered to preclude their further transfers or conveyances of any assets, defendants, along with their assets, effectively vanished after the trial.

We close by observing a particularly salient fact in Kenneth's pattern of deceit and avoidance. This is not simply a case involving an absconding judgment debtor, but a case involving an absconding judgment debtor who has proactively engaged in fraudulent transfers to avoid compliance with court orders and judgments.

From what I understand there was a response due in the Court here January 16, unless there was a postponement on Horon Holdings. The Bailiff was supposed to serve his wife, but they won't find her here. I hear Ken is trying to sell off some properties. Anyone interested in any deals he "puts together" on his properties should beware of all the pending litigations.
What constitutes criminal on this Island?

Hi to all on this blog post.
It is interesting to read about Ken McKenzie.
It seems he is the same McKenzie from the US court case.
Although he did not change his name as Cromwell did.
But the question is, is it not about time that real estate agents should be licensed to operate on SXM? they have to be licensed to sell realestate in the US.
One needs a special degree to operate as a real estate agent in Europe.
So it is only natural that pirates from the US come here to paradise island to hide their identity, make loads of money and contibute not one iota to the islands tax coffers.
I do believe that it is way past time, but we can still catch up with this issue by evaluating our real estate companies, weeding out the illegals, offering real estate courses to our youth and make it compulsory to have a real estate license to operate on SXM.
As long as those real estate licenses are not sold by the politicans as they do with all other licenses and permits.
On another note, McKenzie works for Century 21, owned by D.Alcott who also owns Learning Unlimited school, would be wise for Alcott to distance himself from this man.

After some thought and communication with the poster, I removed it for them because at the end of the day we wouldn't want SXM PE to be responsible for Payton getting knocked off by a hitman for the people he turned against and helped put away. But it seems there are many people who know Peyton's real name so...... I guess there was no point in removing it anyway.

Peyton Cromwell was born David Perry.
He managed to not only change his name but his birth date also, which by the way is very difficult to do. He was a drug runner in the late 70's, seems that he was arrested by the Feds and when his boat was cut open at the Bobby's Marina the entire boat was filled with cocaine.

Cromwell most probably does not have much in his name, he uses other people to be Managing Director etc. He has Island Properties and Carib Trust (could be that the current Director bought him out, but he was an original financial founder) Cromwell has had several run-ins with the law on SXM, fast boats, anyone remember the T.V. series Tradewinds? Around that time he had a boat fiasco somewhere around Oyster Bay.

He also had a boat that ran up and ended up at PJIA fence. Then the biggest crime event, Cromwell was at a birthday party in Grand Case, everyone saw him ordering and drinking Champagne. He left the party loaded up with Alc, got in his jeep and while driving like a stupid in Cole Bay he hit a small car driven by a father and his young daughter. The father drove after him trying to get him to stop, as he had continued after the crash. The father later realised that his daughter was severly hurt.
Cromwell was locked up for one night, why??? Because on SXM the police have no breatherlisers. Go figure!!! French police have them, but the Dutch side police are still in the cave man era. No direct proof that he was drunk, also I believe no investigation was done as they would then have questioned people at the party, unless those people lied or were intimidated. In any case, his drivers license was taken away from him, not sure for how long.

People and myself have seen Cromwell driving his employees cars during the day time hours on the Dutch side. What happened to the little girl? difficult to say, some say that she is a vegetable, others say that Cromwell is supporting the father with money to keep them quite and pay medical bills.

From Cromwell to Ken McKenzie, what a nice picture of pirates SXM attracts to it''s shores. And for those of you that remember, Island Properties sale booth, a small ginger bread style house that was located in Oyster Bay a few years ago, was burnt to the ground by a disgrunteled American home owner in the area. No clear reason why, them say the person was fed up with Cromwell's bussiness tactics.

The sale of the house has nothing to do with blocked views, go see yourself, Villa Gillian has the views.
Unlike other houses that previously had beautiful beach views that are now blocked by the ugliest development in town called the WESTIN.
My take is that the house is for sale so that Roy can make a million dollars.
Building that house did not cost him a cent, so if he can run with the money now, why not?
Now that the news is out, Roy will prefer to sell that house, better than still owning it when the police come to haul his ass off for questining.

Yes.
Roy pushed hard for permits and it is suspected he ignored advice of experts.
Not sure if they built the house, but has been rumored that Westin rented it off him and may have even done some work there. it is not suspected, it is a fact.
The Expert committee negatively advised against the planning permit for Columbia Sussex, Columbia Sussex is the builder of the WESTIN.
WESTIN is the operators of the hotel.

It was published in the newspaper, he blatently ignored his own committee that is set up to advise government on planning permits when there are objections lodged against projects. So please, stop with the suspected, it is a fact that Commissioner Roy Marlin ignored advice to redraw the planning permit development.
No one was against development of the area, but what they did to Dawn Beach is a crime. The beach looks like it is now down to 30%, 70% of the beach is a ugly hotel.
They have built a pool that I suspect (I am wondering if the Kadaster ever went to measure) is on the public beach property.
This could have been a nice development if Caribbean architecture was taken into consideration, balconies, sea views, more greenery and flowers.
And what about their ridiculous retention pond built up a hill, that drains out into the Atlantic Ocean.
A sewage plant up a hill waiting to backfire one day.

Man O Man, maybe a hurricane, maybe a tsunami, maybe just heavy rainfall, or maybe the sewage might just come to show them exactly what they are.
