The permit request has been denied and the document, about 10 pages long, is now up for public review at the VROM office. You can go look at it, but you can't get a copy. Nor can you get a copy of the archaeological study presented to Roy Marlin over 6 months ago by Jay Haviser.

The document prepared by government lawyers to support the permit refusal is of vital importance to those opposing the development, it is understood from a reliable scource that those same lawyers, or at least one of them, recommended that all those who submitted a letter opposing the development should receive a copy.

On the 1st of August, attempts were made to get a copy. You can't get one from VROM, you have to apply at General Affairs which was done in writing. General Affairs did not have the document but did send a letter the same day to VROM requesting them. As of today, it is not known if they have been successful.

It appears Mr Kadamer (spelling?), the head of VROM is hesitant about giving it out, as if he feel doing so may bring some trouble down on his head.

In the case of the archaeological report, if only there was an opposition party or a media with balls. There is absolutely NO reason that this report should not be made public, it is the peoples history and heritage, it's disgraceful. SXM PE would very much like to hear from someone with a copies of these documents, we will publish them right here if we can get them.

There is nothing to stop EWE BV from resubmitting a permit request, if they have copies of these documents then they have a huge advantage over those opposing the development. Have they been supplied with these documents already and why is it proving so difficult for the various interested parties to get them?

As for the 'Cherry on top' title, part of the deal EWE BV was offering government was to build and give to the island a new Governors House. It is rumored that Franklin Richards picked the spot himself, at the top just below the 200m line.

Documents and information are withheld or even hidden from the public on a regular basis. It's going on with the Dolphinarium and many other people and organisations are often left with having no choice but to engage a lawyer to seek them under the LOB law. This is often ignored too by the govt.

Richards is supposed to ensure proper governance and he seems to be up to his eyeballs in the EWE case. If any of you recall this letter, when Henri Brookson said questions about his involvement with EWE BV should be directed to Richards.

We are still looking forwards to and waiting on the documents that Henri promised.

Roy Marlin was apparently on Lloyd's show but I missed it, I did catch a little of Henri Brookson and his chum Toby the 'butler' who were on right after though.

From what I understand, Roy was talking about how maybe the island should consider staggering development, much in the same way Anguilla is doing, even going so far as putting a moratorium on development last year. Problem is, his talk doesn't reflect in his actions.

Henri actually mentioned SXM PE and Emilio's video, he was casting doubt on Emilio's intentions towards his property and that this letter that Brookson has a copy of changes the context of what Emilio says.

What he neglected to mention is that KABNA was a federal government department and that all this was taking place around the time of higher supervision.

The simple letter itself is hardly a sales agreement, it looks like the opening of negotiations and I think it can be assumed that at the possibility of sale became more likely then Emilio would have thought more about it, with more conditions.

What would be very interesting would be to find out what the reply from Mr van Deiman was.

As for the mineral rights condition, Emilio might have thought one day gold, diamonds or oil might be found there, who knows. The point is that Emilio say's he would sell it to the Federal Govt or the Queen, because they would 'take good care of it', make it into an 'historical park'.

Henri can spin and puff out smoke as much as he wants to try to confuse the situation, bringing along his buddy Toby to newspapers and radio shows, it changes nothing.

The IC passed a motion to protect and preserve the estate, the govt promised a 3 man committee and a report, that it would be happy to work with the EWE Foundation to achieve this end. What did we get?

Despite several attempts by the EWE to initiate contacts with govt, nothing has been recieved back. There was no 3 man committee and no report, there is however an archaeological report that Roy has been keeping from the public and interested parties for over 6 months now. Douments are held back and probably even hidden from the public, it's disgusting and disgraceful.

What we have now is court cases because govt was insincere in it's vote for preservation and did absolutely nothing to avoid this situation. Maybe they like it this way, maybe they want to lose so they can get the development that they were originally so enthusiastic about, the Link 7 road, the new governors house, a triffle here and there.

It's a heartbreaking shame we have such a timid media on the island, and they want to put a moratorium on journalists?? You have to laugh or you cry.

The only solution to most of these problems is a change of attitude of those civil servants which represent what we call government today. It is indeed a shame to see from the highest to the lowest level they seek to manipulate the society based on the position that they have in government. You cannot trust anyone of them.

Crime is on the rise and there is noway we can curb crime with the kind of management we have in the police force. The Justice system, including the Public Prosecutors needs a complete overhaul. Again the question is? Where do we get qualified people to take over these positions? We want more autonomy but we are not willing to educate our own to take over. If you are qualified and you support a party other then the DP you will not get the job.

I can continue and write books about the mismanaged of government. Why does it take soo long before a final decision can fall on the outcome of the EWE. Who is responsible to give the final decision. I assume that no matters who owned the property, government has the tools to list the whole property as a hystorical site and close the doors for all development other then what is feasible within the frame work of historical site.

That is the situation with many other issues. Look at the teachers situation, traffic, crime, business, education, communication, social care, sports etc. All is failing and the people just continue about their business as usual. Thank God there is a tomorrow. Because of that it gives me the strength and the courage to continue to be a positive partaker in this society.

I heard the Lloyd show today and Brookson mentioned the letter that Emilio wrote to a man called Van Diemen who worked for KABNA in 1993. What Brookson fails to tell the people is that KABNA is the representative of the KINGDOM government in the Netherlands Antilles. So the video is correct, he approached the right person to sell his Estate, he said he wanted to sell to the KINGDOM government, and not to have houses and shacks here and there.
Brookson and his Emilio Wilson Estate b.v. is not the KINGDOM government.

Brookson can twist and turn all he wants, I hope the people and the government including the Lt. Governor is listening, because he keeps insisting that the Lt. Governor wanted a Governors house there. KABNA has another name nowadays and the SXM office these days has a Mr. Stortelers as the Kingdom representative. Mr. Eddie Williams from Radio Soualiga calls it the "colonial office on Frontstreet"

We need a reporter on this island which is willing to take a stand and do the necessary research on issues like the EWE and come out with a complete report with all the documents and the details of all the people related to this issue. Instead of calling the place a colonial office he should have gone and confirm that is was correct. Maybe van Diemen at that time act not on behalf of the Dutch Govt but as Mr. van Diemen a private citizen. THat is what a lot of people in government does. They hear about a project as being a representative of government and tomorrow they form a company and take over the project. These are the things we need to investigate. Anyway one of these the sun will shine again on Sint Maarten.

You are correct when you state that Van Diemen who was employed with KABNA is/was a representative of the Kingdom Government.
So Emilio's letter written in 1993 is corresponding to his video of 1992 where he states that he wanted to only sell to the Kingdom Government.

KABNA today is known as the Ministerie van Binnenlandse Zaken and Koninksrijksrelaties, or the vertegenwoordiging van Nederland in the Nederslandse Antillen. Commissioner Roy Marlin has already sent the Estate file to the Monument Council for adding to the Monument list. We are waiting to hear the outcome from the Monument Council on their decision.

Monument Council has also heard a presentation of the archeology study given by J.Haviser since more than a week ago.
