SOAB is the organization that functions as the internal auditor of the government of the Netherlands Antilles. Fifteen (I always thought 2010 – 1994 = 16…) years in business and claims to ‘know government’; SOAB has conducted research on how permits were and are granted within the sector ROB (ruimtelijke ordening & beheer/area planning and management). They were requested to do so on the third of February 09 by the ExCo. A year later their 32 page report, with an analysis of the administrative organization of ROB and its internal control measures, appeared.

Amongst others, SOAB has studied
- relevant judicial aspects,
- the permits that were granted in the past (05- march 09),
- processes and measures to maintain internal control,
- conducted procedure tests on correct- and completeness,
- technical aspects
- conducted interviews with the management and (ex)employees of ROB
All that to find an answer to the question: To which extend do employees of ROB grant permits lawfully/legitimately?

Note though, that the selection of files on (big) projects up for examination, was a RANDOM sample of projects that have been discussed in the media frequently. SOAB, unfortunately, did not receive all the dossiers they requested.
A total of 165 dossiers on building permits (combined worth: NAf. 400.000.000) from 05-09 have been analyzed. This was just 9 percent of all registered building requests in that period. 26 dossiers (including Blue Mall, Coral Beach Club, The Palms, Lighthouse, Opal Suites) that were requested, were held back for vague reasons, which SOAB has decided not to look into (?).

Now for the Results
Based on their rigorous analysis, SOAB concludes that systems of internal risk control and control with regard to the granting of various permits is not sufficiently present and in some cases even absent. Nevertheless, there are some standard forms, so some standard procedures and internal guidelines do exist. Problem is, these procedures miss certain crucial points (leads to extra risks) and are filled out incorrectly and/or incompletely.
Standard procedures, in use today do not, for example, guarantee that all requests and permits are registered. SOAB also concludes that there appear to be no formal internal guidelines with regard to certain relevant aspects, e.g. there is no deadline set before which ROB must have responded to a request for a permit, nor are tariffs formalized, and as we have noticed before all adequate guidelines with regard to keeping an orderly archive to safeguard the quality of the dossiers and service, remain absent. Files could even be found in a restroom (?!) and were badly damaged by water.

Judicial aspects
SOAB finds that legislature & regulations used within ROB are ancient (or whatever you call things dating from the year 1935) and therefore not wholly applicable. Moreover, certain laws have not been sufficiently elaborated, as is the case in other parts of the NA. This leaves room for (creative?) individual interpretations of the legislature & regulations. Also, ROB has insufficient adequate control measures at its disposal to grant permits.

I’m not going to discuss the exact outcomes of the analysis (see page 10 of the report for a depressing checklist), just a few facts. The report mentions a quantitative and qualitative deficit within the Permits Department of ROB. All current employees have a MBO-diploma, except for the head of the department. For all Anglophone readers, MBO is more or less vocational education. As a result, complex projects are not duly evaluated. Dollison, Director of ROB, claims that during the last two years all mega-projects have been passed on to a special team consisting of a minimum of three department heads. SOAB then, examined these mega-projects (Aquarius & Caravanseray) and were sorry to find various shortcomings in the said dossiers (too bad Bijlage/Attachment 2 and 3 are absent!).
Next point is that it seems pressure is being applied on VROM/Building Permits by both Dollison and members of the ExCo.
An employee of ROB basically tells SOAB that he pays little attention to legislature or regulations. Instead, he values his experience. Close examination by SOAB has confirmed this employee’s modus operandi.

So we move on to the Inspection Department…
Inspections have not been conducted adequately (often not) an example: the Blue Harbour building is twice (!) as big as the floor plan of the building they were granted a permit for. It is unclear why no measures have been taken, while there do appear to have been a few inspections.
There are even cases, analyzed by SOAB, that point to the strange idea DROB seems to have about his power to decide whether the law is applicable or not. La loi, c’est DROB? Lol!
Now, for safety: fire prevention. Only 20% of all building requests receives an advice from the Fire Department. Not that anything is done with these, but you know, for the record :)

Anyway, the report goes on with saying that some employees, such as the DROB and his deputy, are far too amiable folks. For instance, they meet with developers outside office hours and forget legislature if that suits the developers’ fancy.
As mentioned before, legislature and regulations are not only disregarded but are also ancient and incomplete. The consequences of which include individual interpretation and ARBITRARINESS. SOAB calls that undesirable… my word would be ‘corruption’, but this is not my report…

Quite a number of buildings on this island were built without a permit and are presently still illegitimate. ROB is aware of this, but takes no measures. And as no sanctions follow illegitimate actions, such as, the taking down of buildings constructed without a permit, ROB loses all credibility. But the worst thing is, the island’s landscape is completely destroyed and nothing can undo that damage. So, F U ROB!

SOAB demanded a registration of the permits requested and granted under the nuisance/hindrance act from DROB, but has never received any. From the interviews conducted with employees of ROB becomes clear that this ordinance is fully replaced by individual interpretations (?!). Employees, for example, are firmly persuaded that noise pollution is not mentioned in the nuisance act, while this is false (see article 11).

The way permits are granted on SXM is simply irresponsible.
Requests are insufficiently considered, but do get the green light.
Permits are being granted without legal basis.
Even after faults have been found in the evaluation by ROB, permits are blindly granted.
The employees conducting the evaluations do not or do not know how to apply legislature.
However, they do apply: Tone at the top. Which means that one does certain things while one is aware of them not being allowed or right, but one justifies this by pointing out that the person who bears final responsibility does not set the right example.
From the interviews, SOAB could conclude that everyone within the sector ROB, management included, had some sort of individual interest in certain projects and represented that interest accordingly.
Employees also said they had been offered money in the past (bribes) but of course they had refused to accept it. Hands up who thinks these people are veritable angels and half gods? Lol, OK, so as you might suspect, SOAB was unable to find any supporting evidence for these statements.

Next, the two (corrected :P) points from the conclusion, mentioned in an earlier post:
1. DROB lacks both crucial managerial and technical skills, which explains his incapability to fulfill his tasks properly;
2. DROB has wittingly taken certain actions c.q. neglected taking certain actions.

The recommendation to the ExCo by SOAB includes reorganizing the ROB, getting rid of the current management (could be given disciplinary punishment considering the fact they have infringed lid 1 and 2 of article 82 of the Landsverordening Materieel Ambtenarenrecht/LMA), appointment of interim manager (from outside ROB). Also, it is recommended that all employees should be forbidden (subito) to conduct any of their sideline activities without permission (LMA, art. 55). Moreover, all employees needy of should get not only extra training in applying current legislature and regulations, but also in dealing with pressure and integrity. SOAB goes on with recommending that the case ought to be handed over to the Public Prosecution Service, since SOAB does not have the power to prosecute. in addition, SOAB recommends that govt revoke the mandate given to DROB, as a result of the findings of this report. The legislature from 1935 needs to be elaborated by for example adding what the other islands within the Dutch Kingdom have added over the years. The nuisance act needs to be updated. Lowlands needs a zoning plan. Inspection should take place and if the construction of a building is not according to the floor plan for which they were granted a permit, measures should be taken accordingly. If nothing is done, no landmark decision will ever set a legal precedent.

So there, that’s why this island’s an architectural drama.

Great read and analysis, thank you. With the recent disaster in Haiti is makes you wonder how many of these buildings that have been built illegally with extra floors and few if any inspections are earthquake resistant or with fire safeguards. The total lack of any kind of action from William Marlin and his crew in govt is just so telling of how weak and pathetic they are when it comes to good governance. Just like the crowd before them. There has been no indication that they take this matter seriously or have any intention of dealing with it with intelligent resolve.
Nor for that matter do the people of the island or the media seem to care that much about putting any pressure for answers and action. SXM's politicians are in no way capable or able to govern with any intelligence or integrity as far as I see it. I was listening to William talking about more USONA handouts, is English his first language? So painful to listen to his slow drawl, makes one wonder if his brain is moving the same speed, erming and aring, repeating things like the listeners are fricking idiots and appearing so much like one himself.

I'm so sad for SXM, there seems no real hope for the future in sight.

Hello, i think you have it wrong because these permits where giving out before the National Alliance took over Government.
The former government should be held responsible for there weak actions on St maarten.Rest asure this whole mess will be seriously taken into consideration.Lets take a deep breathe here and come to the realisation that St Maarten needs help and powerful governance to guide us in the right direction.Any employee who is convicted of fraud and not carring his/her task on the job they way they should,must be removed and fired on the spot.Get rid of them.
The world is looking at St Maarten as if we are a comic book ready to sell it self.

The NA, by it's failure to act decisively on this report (nothing has been done yet) are showing that they are not capable either. While the mess was created by the DP's incompetence, in particular that of the most incompetent of all, Roy, the NA are showing no sign that they intend to clean up or set things right. Seems to me they are twiddling their thumbs.

Yes, SXM needs strong governance, but I see no signs the NA are capable of it. One or two of them I like, but in general they are pretty much the same as the DP, no vision, dumb ideas and no sign that they understand the concept of transparency and good governance.

This is just my opinion of course, one I think a fair few others share, and it's worth whatever value you give it :)

Sad. This is the exact same thing the herald wrote almost two pages on but everybody acting like its some revalation. The paper has been doing a thorough job on the SOAB report and all its angles. ALL media has been following their lead and can't get the info they've been putting out. It's dishonesty like this is why this site is about to perish. People recognise bullshit when they read it. Give credit where credit is due. SXMPE trying to toot its own horn again or that of one of its writers. Pathetic.

By the way, due to my being off-island for a yr, please excuse me for being unable to read the Herald or the Today. So, unfortunately, I missed out on the two pages SOABcoverage you mentioned. Of course it was better than my blog! I am not trained to be a journalist!

1. First of all it is you that is pathetic, you are obviously f%$king clueless about this site. We don't have any 'writers', this site is OPEN to anyone who wants to write a blog, but obviously that fact has escaped your limited and ignorant mind. You don't even seem able to create a sign in name, nor do you even put a name to your comment, and I DO NOT mean your real name because as has been mentioned here multiple times, we don't care who the writers are, we prefer to focus on what they have to say. I guess your reasons for not even putting an alias at the end of your anonymous comment is because doing so would allow people to see which comments are yours and what a f&^king moron you are.

2. Your defense of the DH indicates to me that you either work for them or have some affiliation with them. Either way, let me remind you, and the readers of this site that the DH is a complete failure when it comes to investigative journalism, the only reason they have something to publish is because they are using someone else's investigating, the SOAB's.

I will remind you that those who chose to write on this site have been revealing and exposing just about all of the irregularities mentioned in the SOAB report again and again over the past 5 years. Blogs have been written about Dawn Beach, Aquarius, Rainbow, Cupecoy Yacht Club, Indigo Bay and many others long before the DH got the SOAB report and had their work done for them. In fact, the DH over the years has done very little to report on developments and buildings mentioned in the SOAB other than to publish puff pieces quoting almost ad verbatim the developers, and Roy Marlin's claims about how wonderful they are and how many jobs they will create.

Here's a story for the DH, find out how many LOCAL's are employed at the Westin, is it 450 like Roy Marlin claimed and the DH applauded?

Enough, I don't need to say anymore, I trust that regular readers of this site know full well who the pathetic one is here. The writers of SXM PE have been writing about all this for a long time, while the DH kissed ass and did nothing, don't go saying they are investigative, they are nothing of the sort.

Again, apologies to readers for my language, sometimes you just can't help it when dealing with ignorant dumb people.

Another example of blatant wrong doing is the granted permits for the large box building in Cay Hill on the hillside.
The building was built by Samir Andraos who knew full well that he obtained a planning permit to sub divide the land into commercial on the roadside (see his tour bus business) and residential on the hillside.
Mr.Andraos nevertheless goes about his own way and builds a massive multi-story concrete warehouse up on the hillside not in compliance with his planning permit...but lo and behold.........He receives a building permit signed by Mr.Dollisson in total disregard to the planning permit.
The building permit should follow the guide lines of the planning permit for those of you that are not aware of how these things work.
When the Lt.Governors office and the SOAB investigates, Mr.Dollisson says it was a simple mistake on his part..an administrative mistake.
Now readers here please tell me.... if this was anywhere else in the world... Mr.Dollisson would have been fired! But here in SXM there are no sanctions. Civil servants can do what they want, make all the so called mistakes they want and still hold down their job without their boss the Island government holding them responsible.
People darn well know this was no mistake but a deliberate attempt to give Mr.Androas what he wants...Andraos no doubt paid Dollisson to get a building permit for a commercial building up the hillside because he knew his planning permit clearly stipulated otherwise.
When questions were asked Mr.Andraos started making excuses like yes it was a mistake but one made by the ROB Director, not his.
Then he made comments as to the building is residential as he is bringing bus drivers to live on the top floor.
Then it turns out that Mr.Andraos had the building built higher that what is even stipulated in the questionable building permit he obtained from Mr.Dollisson.
I am sure readers now can see that this is a perfect example of developers on SXM cheating their way in order to get what they want,how they want and will pay off whoever to get it exactly as they want it, knowing that they most likely will get away with it and the civil servants will just call their action a mistake and no sanctions will ever be taken to hold the civil servant responsible.
In this mix of drama is also the Mr.Claudius Buncamper factor...It appears Mr.Buncamper is somehow involved with the business of Mr.Andraos. It is not quite clear how, maybe Buncamper leases a tour bus license to Mr.Andraos, but one thing is clear; and that is Mr.Claudius Buncamper is walking around speaking to as many people as he can trying to put a twist on this drama by blaming the Lt.Governor.
He is also making rumors about the people that sent in their written objections against this ugly monstrosity of a building that is an eye sore on the hillside.
This development is written about on page 20 of the SOAB report.
It is under OLZINA N.V and the area is called Vorst estate.
The land was sold by the Vorst family to Kashmir Investment ltd (Samir Andraos and V.Iglesia) Later on another company set up by Andraos,Olzina N.V. makes requests for the building permit.
Please pay attention to the cost associated with the building, fls.500.000 is way below the actual price, no doubt this was done so that Mr.Dollisson could sign and not the Executive Council.
The question is with this and all the other developments brought froward by the SOAB report; where are the sanctions? Is the Executive Council so afraid of losing political party votes that they refuse and ignore to fire civil servants that are blatantly corrupt?

You are 100% right with your comment. But please dig further and you will find that a next building 6-7 floors will be buildt where Samir own a piece of land. Yes the same Vorst estate, just opposite Sea Breeze. Only he got a planning permit to build so high- the other commercial buildings around were denied. Hmmm I wonder who signed that Planing permit and how long will it take for Samir to get his building permit.......Will his building permit goes to EXCO?....

Ok, I'm not religious but is it naive to wonder how these people like Samir, TO, Roy, Marcel, Cor and so many more can live with such a conscience? Should we measure that by alcohol units?

Wednesday, February 3, Island Council members, the Governor, Commissioner Xavier Blackman, as well as Island Secretary Joane Dovale-Meit, Quartermaster for the Parliament of Country Sint Maarten Cassandra Janssen and the Sector Directors will be attending a workshop on dualism.

I am SO convinced this will be IT. Totally.
Copy the system from the Dutch municipalities and tada Problem Solved. Yeah right. Did they forget they were NOT dealing with tabulae rasae here? I have no faith in it at all. What about you?

How Samir has pushed dirt up against the walls of his Box Building on the hill in an effort to make it look smaller, perhaps to say that the bottom floor or two are actually basement.

Would be interested to hear more about this new building you mention.

The reason why the ExCo (Theo to be more specific), is not sanctioning Dollisson / Buncamper is the simple fact that these guys have done "favors" for Theo (and others in the ISLAND council) and will expose these favors once their ship goes down. That's why they get a chance to respond in writing (again) and are not suspended (just like Delano was) but may carry one working as if nothing has happened in the mean time.

And most probably the only "sanction" the ExCo will impose is a little little slap on the wrist (reprimand) and that they should be transferred to another job within government. In Dollisson case, he may go on pension (a rich man) straight away.

There is simply no other reason why, after such a damaging report comes out, the ExCo would not simply follow tSOAB's recommendations and also forward the report to the Public Prosecutor's office.

The SXM system is broken beyond repair and law abiding citizens are becoming victims of the greedy actions of cronies such as Dollisson / Buncamper.

St Maarten is obviously not a Rechtsstaat.

In Afghanistan we have the corrupt warlords that shouldn't be in govt; in St Maarten we have the old rotten elite that shouldn't be in govt. Both lead to chaos and bad governance.

SMN news reported the resignation of Mr Guy Gumbs as head of Permits. Appearently pressure was applied to the good gentleman to sign off on permits for a company owned by Samir.
Mr gumbs is now a whistleblower and we need more of Mr. Gumbs types to come forward and report the wrong doings, for the simple reason to rid ROB once and for all of the obvious funny business and disregard for the rules we all have to follow when applying for building permits. SMN news also published the memo sent by Mr. Gumbs to Mr Dollison, who by the way, according to reports is ill.
What does the EXCO need now? What will be their next move be and how long will it take to remove the vail of corruption down at the yellow building.

Is everyone with me when I say that it is more than HIGH time for higher supervision to take over the Public Works department?
The EXCO and the IC seem reluctant to handle the SOAB report and follow the guidelines which call for the firing of Claudius (Toontje)Buncamper and Mr.Dollisson.
They seem to believe that this will evaporate into the sky and people will forget.
I will even call for Mr.William Marlin to be a man and call Theo Heyliger his coalition partner to hand over the portfolio-Heyliger is misusing this portfolio of public works and environment to suit his building of the ring road, the filling of Cay Bay, building a new pier that not one tender uses.
Yet, Heyliger cannot fix the real infrastructure ills, like the massive amount of sewage running through every neighborhood on the island.
I am hoping one day to see a real protest, one where people get so fed up they will take their sewage and dump it in Theo's yard in Guana Bay. While everyone sees, smells and have to endure muck and guck running through the road side drains in front of their homes, Mr.Theo lives grandly in Guana Bay without a worry in the world.
I say take the muck and dump it at Theo's house!

As a sort of garden soil fertilizer, you mean? In order for him and his family to 'beautify' their own surroundings? Yes, great idea, give him a call on ####886 to make his day :P
