Objection Letter to requested Planning Permit (nr 05059) for Emilio Wilson Estate
The Save Emilio Wilson Estate Committee have taken note of the request for Planning Permit (nr.05059) for a residential development of Emilio Wilson Estate that is on review at the VROM office and are objecting to this planning permit as it does not contain the proof of ownership of the property.
One of the documents required to be submitted before a planning permit goes on review, according to our information, is the proof of ownership or property deed and registration. The property in question is still in the name of the late Emilio Wilson and as such no transfer of land has taken place.
We are also questioning the validity of the developers by the name of Emilio Wilson Estate B.V. Research done by our committee has not found this company’s name registered in the Chambers of Commerce registry in St. Maarten, the Netherlands Antilles, Aruba or the Netherlands.
The planning permit states that the Emilio Wilson Estate B.V. bought the property in mid August 2005. However, this property has not been purchased and has not been registered in the name of Emilio Wilson Estate B.V., also to this date no registration has taken place in this name Emilio Wilson Estate B.V. at the Kadaster office with a notarial deed.
For this reason, the committee would like you to consider this Planning Permit null and void and perhaps even fraudulent in nature.
We have also taken note of an article printed in The Daily Herald September 17, 2005 edition in which Environmental Development and Property Management Commissioner Roy Marlin responded to a question posed by journalists in the Executive Council Briefing of Wednesday, August 14, 2005 regarding the ownership of the property in question.
Commissioner Marlin is quoted as saying “There is no clarity on it, it is one of the tasks of VROM to request that the developer submit that particular proof of ownership.”
Our committee is urging government to take the above mentioned points into consideration and reject the planning permit request.
