Miss B’s Vendor Pleads With Duck To Respect Court Order

Dawn Beach:- The owner of Island B’s Joan Veerwoord is now at wits ends and is pleading with Peyton Lee Cromwell of Duck International to stop harassing her and to respect the court order and the decision of the Executive Council.

Veerwoord just recently got a victorious verdict when a judge ruled that she could remain on Dawn Beach and do her business as usual because the Executive Council granted her a license to operate on the beach. Verwoord told SMN News that Cromwell has now taken on a new approach she said that the developer wants to reach and out of court agreement with her.
“Only last Friday this man invited me to a meeting and the meeting lasted about ten minutes, Cromwell wants me to move into his three-story building that might have to be demolished.,” she said. Cromwell did not respect his building permit, something Verwoord pointed out the judge on June 29 during the civil case hearing. He has a building permit to build a two flat building but instead he built a three flat building.

Now Cromwell wants Verwoord to pay the sum of $200,000 in a three-year period to occupy a part of the bottom floor as her restaurant, in a building that is not in compliance to his building code.

Verwoord said that she is tired of the harassment and if the developer Cromwell Peyton does not stop his gimmicks and respect the court and government, she would have no choice but to seek assistance from the court to have Cromwell stop harassing her. “I am waiting until the beginning of the high season and if I am not able to conduct business peacefully, then I would have to do something to get Cromwell off my back.” She said.

Verwoord said that this is not the first time the developer made proposals to her, but each time they talk to me, they file a court case. “I cannot trust this man and his lawyer, I don’t even want to engage in talks with them because I just cannot trust them,” Verwoord explained. She is asking the island government whom she said is working in both her interest and their interest to see if they can put a stopping to Cromwell behavior. She said she wants to do her business in peace and they should do theirs and allow a peaceful relationship to develop in the area.

Efforts made to contact Commissioner Theodore Heyliger proved futile up until press time.

They did settle. I read something about it in the Herald on Saturday. She collected a hefty sum from Duck

I think you guys better wait for Joan Verwoord and Peyton Cromwell to respond to what was exactly settled.
Last time I spoke to Joan she told me that she has settled with Cromwell and Lucky to be moved to a new establishment somewhere that she did not know at that time.
However, her chair and umbrella rental will remain on Dawn Beach as her business, what is moving is the BBQ establishment.
Joan also said that the constant court cases took a toll on her family and her family's health. Court cases and paying lawyer fees was and is still not easy.
Cromwell and Lucky wanted Ms. B's to move because according to them, she was obstructing their ugly concrete houses view. I think they could easily could have come to a solution where Cromwell and :Lucky could help this lady upgrade and beautify her BBQ spot.
So if she settled with these people to get them off her back, well I guess thats what it took, I do wish she would have stuck it out to the end, But I do understand that court cases take a hefty piece out of your business, family and personal life. I only hope that Joan settled for a large amount to compensate for what she had to give up.
On the other hand... Cromwell seems to love courtcases, so when will the court be handling the 3 floor he added to a building that intentionally was supposed to be 2 floors?
When will the court be handling all his badness that he committed against his neighbors?
You see... some people just love a court room. In the meantime ask the visitors who enjoyed the island flavor of Ms. B's how they feel about Ms.B's moving from the beach.
Peyton Cromwell, Lucky and some of those very nasty people employed at certain Commissioners offices don't have a clue on what visitors to the island are seeking when coming to enjoy the island life.
They think people are going to enjoy those ugly boxes Cromwell built? those things are disasters waiting to happen in the event of a hurricane.
I saw what happened with the passing of the outer bands of Hurricane Dean, those buildings had the sea up to the buildings, and the ones on the far end had the ocean splashing in the pools.
I am sure that the real estate agents will not enjoy what I have to say, but I will say it again to all investors coming to the island; BEWARE of all buildings that have been built too close to the ocean, especially the ones that are only 6 meters and 18 meters away from the ocean.
On SXM we have a beautiful law stating that development should stay 50 meters away from the high water mark, looks really nice on paper, the truth is that developers build way up to the high water line with minimum supervision from the Governments environmental department.
