Emails and Allegations

Last week we published the contents of two emails we recieved, emails that were sent far and wide. Two more emails that followed detailed allegations against Sheriff Security and a local attorney.

Some appear willing and even quite eager to dismiss these allegations as the made up stories of a suspect character, some say he is wanted by the CIA or FBI, some say he is a crook too, involved in and wanted for his own sketchy dealings here on St. Maarten and elsewhere. No one has yet provided any information to verify any of this, however, the writer of the emails has provided plenty of information which can be easily investigated and verified or disproved, if the police force and prosecutors office really wanted to.

Regardless of the allegations and stories about the writer, the charges made in his emails are clear, easily investigated and very serious. The longer the authorities refuse to address and look into them the more credence is given to their contents.

We used the House of Cards in the previous blog title and the Jenga image in this one because that is the situation we believe the police force and prosecutors office are in. If they really started to follow these leads and rumors then the whole lot may come crashing down. With the Loor case, the numerous other cases against police and immigration officers, siezures of illegal guns including AK 47's, bank accounts with millions of dollars, huge drug siezures and more, you could say the situation is pretty grim.

It's been pretty grim for a long time now, and a coat of paint isn't going to be enough to cover up the cracks.

So if everyone is investigated and everyone goes to jail for their wrong doings, what will happen to Mr. JST who happens to be in St.Domingo? How will the authorties get him if there are no extradition treaties with this country?
Mr. JST could only have obtained all those bank accounts numbers from the Sheriff security and the lawyers office because he was directly doing business with them.
And I do not mean as a client but as a business partner. Could it be that he cannot file a complaint as a normal person because he will have to give details how he was a bussiness partner with them and the origins of his invested monies?
So lets assume it is true what this email writer is aledging, you claim he gave plently of proof, but did he? All he did was say that the woman and the husband are involved in illegal activities with allowing illegals into the island, is this true? Did he provide enough proof of this? What if it was you that was targeted for slander by a disgruntled ex-business partner? Would you enjoy being targeted as well in this manner with slander? By someone who has already left the island?
So lets assume that indeed the immigration officer and her husband are guilty, assumption here, should Mr. Scotty get a free ride in St.Domingo while the others are jailed? While he collaberated with his so-called investment schemes?
The only way this will ever get investigated is if a team of Dutch officers do this job, absolutley no way this will be investigated in the local police force. You cannot ask the locals to investigate their own.
And what about Mr. JST? How do we get him to answer and connect the dots? Is he man enough to come back to SXM to make the charges in person? Or is he more afraid of others out there in the International community who is out to get him?

There was plenty of clues, leads and information in the emails, and the ones that followed, that give the authorities enough to look into, if they wanted to, enough to be able to determine if there is any truth to the allegations or not, to dismiss them or investigate further. These are not misdemeanor sor to charges, they are serious and they should be taken seriously, regardless of the source.

That's all. The longer this goes on the more credence and credibility the charges have, including the one about the police not wanting to investigate their own. The response from Stein is lame and totally unsatisfactory.

I read a story in yesterday's issue of the Today Newspaper, writen by the new Dutch reporter. What is interesting in the story is that man spoke to a lawyer and the lawyer who kows so much about Tucker did not want his name in the paper.

Leaves me to think that it is either of the two lawyers that was mentioned in the email. Not to mention one of the lawyers wrote Tucker and asked him if he thought he would get through to smear his name. The fact that everyone by now know that Tucker is a crook and he was involved in illegal business leaves me to wonder why these two attorneys fall apart. But where is Tucker money they help laundered. Why does everyone thinks that these people he named is not as guilty as him?

What is an immigration officer doing with such a friend may I ask?
I wish the people in the judicial system ignored that story in the Today and start investigating. Tucker is wanted he will be found but if those who are here were actually involed we cannot allow their nest to grow

The Chief Prosecutor is quoted in today's Daily Herald, “Because it does not come from a known source and it is as such an anonymous letter, there is no other conclusion for the moment than that it is slander.”

He is saying that if I tell you about someone who committed a crime, but fail to give you my name, this is proof that I am lying. This is a bizarre conclusion from someone who claims to have gone to law school.

Mr. Stein should also be aware that letters give rise to libel. Slander arises from the spoken word.

I would like to point out that those terms are common law terms. Sint Maarten does not have a common law system and as such neither words should be used. Your remark is correct but irrelevant from a legal point of view. Courts on Sint Maarten don't work with common law concepts of tort. It is better to use the term "Defamation" or rather qualify the written or spoken word as unlawful.

Slander or Libel?

The Dutch law system talks about "smaad", which is more or less equivalent to defamation or slander, libel I would hold equal with "onrechtmatige daad" or "onrechtmatig handelen".

So your references to common law do not really hold ground. The law sets out rules on what is permissable and what is not. If someone feels slandered or defamed or is of the opinion that someone acted incorrectly towards him, they have the option to take it to court. And that is where the final borders are drawn. Laws are an outline, jurisdiction determine the real borders.

Tort does not exist under the Dutch law system, but has absolutely nothing to do with slander or libel, and mostly focuses on class action suits for product disfunctions or bad medication.

By the way, it would be good if people kept their third, fourth, fifth or whatever hand gossip to themselves. Stick to fact, if they are available. If not, wait to hear, listen and see.

If you really have hard info come out in the often. GOSSIP in itself can become slander if it is persistently repeated. Who to charge would be hard. Inventing nonsense is another case altogether.

Firt of all Annalize this they are not guilty as accused but Stein contacted ther boss, next you know they went to the prosecutor to say they want to be the ones to file charges of slanderin... Well the monkey wrench did not work. If they innocent they would request that Stein call the federal detectives to conduct an independant investigaton.

With all these charges and counter charges about who knew what and when they knew, people going to jail or about to go to jail, the police this and the prosecutor that, I have one for you.
For some time now I have been hearing a rumor, a very persistant rumor
about a large Antillian bank here on our wonderful island defrauding a client out of a very large sum of money! If ten percent of what I hear is true then
anyone here with bank dealings need to be very, very, careful. I was told
that both the prosecutor and the police are aware of what went down but
as far as I know nothing has been done.
Question; are the banks here another class of un-touchables that can
steal hundreds of thousands of dollars from their clients and nothing is
done about it?
If anyone out there has any information please let me know

Sxmpe has some exellent reporters and investigators. You should give away a little more information and they will do the rest. I was thinking of making a proposal to Mr. Holiday to give the sxmpe a contract to establic the secret service department for the local police force.

I would like to ask the writer of the bank fraud allegations if they themselves are engaged in any criminal activity, it seem this is very important in determining if your allegations have any value and are worth investigating. Please produce a clean police record and we may listen to you.

Also, please be sure to have plenty of evidence and proof. Names, accounts, phone numbers and details of the allegations are not enough, we require you to also have photos, audio and video evidence and statements signed by at least 3 witnesses.

Based on the statements Stein is making in the newspapers I dont see any investigation into this matter. Stein wants to claim that there is no signatory to the letter.
About the person who writes the racist comment "have mercy on them" maybe they are overwhelmed with what is in the emails you posted for the public to see
I commend you for doing so! I have never witniessed racism on SXM but I would not doubt the existence of it either. Statements such as these needs to be backed up. What you can do based on your post edit the racism out, put it at the bottom of the post and give the people the opportunity to read the questions... Only an Idea! Cause I would love to read the questions too.The accussations in the emails which can very well turn out to be true is not good for sxm image and the people are frustrated. you have being giving people the opportunity to voice their opinion and remove some of the tension they have, Please do not take that away... SXM does not need a crisis situation

clean police record, there is plenty of evidence, and no I don't believe these people
are involved in any criminal activity! There are people here who manage to get by

My comments were based on the current issue of the emails about alledged corruption, fruad and more with a big company here and others, It seems that despite all the information provided by the writer of those emails, who himself appears to be wanted too, it is not enough for the authorities to really look into.

I was being cynical and slightly sarcastic, not at the writer of the comment on the banks, but in general. Apparently rumors and allegations are not enough on the island to get the authorities to look into something. Like Papillon, the guy who just got freed, he reported the problems with Hughes to the police and they did nothing. It's really no surprise that the crime solving rate is about 15%.

Flipper: I can give you plenty of information on the scam perpetrated by that
well known Antillian bank. The amount in question is six hundred and sixty
four USD or more then a million gilders to a so called contractor and was to
cover certain work which was not done
The person who has the account and was the only person authorized to sign
on the account was never consulted, did not sign nor in any way approve
of this transaction. Question: Why would high ranking bank officers get
involved in anything this sleezy, whats in it for them? I am told all these bank
people admitted the bank made a mistake but refuse to do anything about
replacing the money. Not being a lawyer I can only say this whole thing in my
view stinks of fraud and embezzelment. I think there must be others out there
who have gone through the same thing!

You really do have impressive sources, however to the well known swindler
AD you need to add another well known swindler SV. By the by, there are stories
coming out of Anguilla that this disgusting pair are involved in some sort of
scam to defraud a local man over there. Also whilst the bank (WIB) tried
to blame it all on a employee seems said employee wouldn't wear it.
Think about it, how could a employee ever get over six hundred thousand
dollars out of a account? Without question a very high ranking bank
officer would have to be involved, perhaps more then one! For me the
truly interesting question is why said bank officers would get involved
in anything this crooked, has to be a very lucrative reason.

Right on! Both SV and AD are rotten to the core, low lifes, a disgrace to their
families and the island. I think I may be able to solve the mystery of why the
bank hasn't gotten the law involved. If in fact the bank is involved in a cover
up, which I am sure they are, the last thing they will want is to have the law
involved. Then of course there is plain arrogance, how dare anyone question
"the bank " these people have been doing whatever they please for a very
long time.
Think about it. Sint Maarten is about to launch itself into a brave new world
with a new status " country Sint Maarten! " How could anyone take us
serious when we have this sort of crap taking place and nothing being
done by the authorities to call this bank to answer? Is it to be left to one
person to try for a little justice?
Another aspect that comes to mind, I always thought the idea of a police
force and justice system was "prevention." If that is the case then should
not the law be putting a stop to this type of thing and if they know there
are swindlers and the like out looking for more people to cheat. If that
is the case shouldn't the law ensure that these people are locked
and the jail thrown away?

--- Allegedly Committed International Crimes-

Philipsburg:- The writer of several emails that has been sent to several media outlets around the Netherlands, Netherlands Antilles and the Caribbean accusing a female immigration officer of wrong doing is a wanted man in several countries SMN News discovered.

The man who identified himself to this media as James Scotty Tucker was living Dawn Beach area while on St. Maarten. SMN News discovered that the man is the holder of more than one passport and has more than one identity. However, his birth place is Ireland.

In his emails he labeled two attorneys at law, whom he said were doing business with offshore companies. He further claimed that the legal representatives were doing business with a local bank and provided bank account numbers that the attorneys used.

Tucker also accused a Security Company for conducting illegal business, since the company advisor is a police officer. He accused the Police Department for covering the crimes that he said are committed by the officers.

Based on the investigations conducted by SMN News the man did business with the attorneys who apparently were holding monies for him. SMN News further discovered that attorneys do hold monies for their clients in special accounts. Seemingly the man is angry because his monies disappeared without his consent.

He also tried investing in the Security Company where he bought an armored vehicle. According to our investigations the man had several people on St. Maarten conducting business for him. One of those people is the husband of the immigration officer whom he accused of wrong doings. The woman husband J.A SMN News understands is the one who sold the armored vehicle for Tucker and never turned over the monies to him.

Tucker said the man J.A has $6000 for him but he did not file a complaint at the police department for this money. According to him this is petty cash.

Tucker said that his information is 100% valid because he did business with the people he labeled, he also said they are his friends. He admitted that he is out for revenge and can be considered vindictive.

SMN News understands that the man is involved in money laundering and other illegal business and for this reason he fled from St. Maarten.

Since scandal broke last week, the police department has assigned Police Commissioner Richard Pannefleck to investigate the allegations.

Permits me some space in your news papers for me to get my point across.
Ladies, and Gentlemen, young and the elederly, today the island of Saint Martin is faced with one of it,s most dangerous election that we have seen in the history of this island.
This election is no longer about who is going to run this country but who want to get the power.
I am a Fleming, but our families have been running this country from the first mayor Mr Pierre Auguste BEAUPERTHUY untill the last mayor Mr Albert Fleming.
In my opinion the best mayor that have run this country was Albert Fleming for the the simple fact that he never act better than no one out there, he did is share of good but he also did his share of bad. But let us be honest today does Louis Constant look like a man than you can aproach and have a conversation with. He is my uncle, and he told me personally that all he would like to get is is face up on the wall on your way up the stairs in the mairie. That is a promise that he made to his mother, so we need to ask our self what kind of man, that we will be voting for on the 8 july 2007. Louis Consatnt will sell this country out to the white man. If Louis had love the french side of this country, why would he be living on the dutch side? Leopold James letter to SMNN

With a sense of annoyance and disgust, I read a letter to the editor the Daily Herald of this morning, Tuesday, July 03, 2007. Whether or not the article itself is truthful or not, to me is not relevant for my disgust for the character or lack thereof of the writer, using the name a “FLEMING as a most obvious disguise.
Personally, I Leopold JAMES and our organization the SNBF/ L’Esprit de Concordia as well our radio-program NATIONtalk, have always distanced ourselves from anonymous letters to the editor as well as from people calling in at our program refusing to identify themselves. We simply do not accept, nor tolerate.

Consequently, we rather have no-one calling in, or having to close down our program, if that would be the price, but we loathe ‘twilight acts’ I believe that people using anonymity or false identities as a ‘cover’, while assassinating the characters of others, are cowards and very poisonous to any self-respecting society. This, because, while they usually attack and defame the reputation of others, they themselves hide in the darkness, afraid to identify themselves and to defend their accusations.

In any self-respecting country or society, this vive and evil should be exposed and destroyed, because it contributes towards an atmosphere of darkness, malediction, distrust, suspicion of innocent people and the like. In addition, it sets a tremendously bad example for our young people, knowing that it must be an adult writing these type of anonymous letters.

Although, I can go on and on and on, I will end by pointing out that in my opinion editors and talk-show hosts themselves have a responsibility not to give these type of elements who make personal attacks any opportunity to do such, unless they publish or mention their names as well. While, we believe that people in general have the right to question and to be critical of public-figures, doing such on a level playing field is a matter of fairness to all and makes everyone accountable, also the ‘pitcher’ of the ‘attack-balls’.

Obviously, those afraid of identifying themselves, know that they have nothing valuable to contribute, otherwise, they would feel proud to share it with the world. So, a word from the ‘wise’.

In that case, please spare the world having to read your indefensible thoughts, or having to listen to them, but listen to others who at least have the courage to defend what they believe in and to consequently identify themselves.

And laughed. Perhaps whomever posted it here thinks we care what Dr. Leopold has to say? Sometimes perhaps we might agree, or at least understand and sympathise with where he is coming from. The letter written by the so called "Flemming" would not get published here, it's trash.

In regards to anonymity, what Leopold thinks really doesn't concern us much, his letter isn't really about SXM PE, it''s about the letter, his show and SNBF, if he chooses to refuse any anonymous content then that is his perogative and he is welcome to it. We at SXM PE welcome anonymous comments, we prefer people to make a user name, but it is not required. We don't care so much who the writer is, we are more interested in what they have to say.

Mind you, he is right in some respects, some people do abuse the anonymity option when writing comments here. As I type this I know there is another comment waiting to be published, although the writer has one or two interesting questions, it also has a character attack in it, basically calling someone a racist. The reason given for this accusation is about as weak and thin as you can get, it's really quite pathetic considering all the other things that person has done. Calling someone a racist is not an accusation to throw about lightly, sadly some people do.

The comment won't get published, if the writer wants to know why I think they were wrong with their accusation then they should email me and I'll explain why.

Far too often unsupported accusations of drug abuse, adultery and other similar personnal issues and character attacks are found in comments here. They are not very welcome.

that letter was from an email that says Albert Fleming. (hoax address)

IT had tons of mistakes which I beleive was on purpose.
It was not signed "a" Fleming. It was signed A. Fleiming. If I was not a receipent of the letter I would have beleived what the Herald wrote. Gordon Snow is looking start a war on the French side it looks like.
