westin damages telem cables

Will Westin be liable to pay for damaging TELEM cables and keeping customers without phone and DSL lines ?
Can someone in authority in TELEM answer this? Why is TELEM apologising to the people? while it is Westin who should be apologising?
I would like to know how does GEBE/Cable/TELEM and others handle developers and outside contractors who damage cables and leave customers without water, electricity, phones, internet, cable tv, etc.
Shouldn't the WESTIN be liable to pay the costs of the repair back to the company? and the company should be able to give back to the customer what it lost?
